Types of Data Collected

Depending on the services used, we may process the following categories of personal data:

  • Identification and contact data: first name, last name, email address, phone number.
  • Account data: encrypted password, login credentials and preferences.
  • Shipping and billing data: shipping and billing address, city, postal code, province/state, country, company name, Tax Code and/or VAT number.
  • Order and after-sales data: purchased products, amounts, order status, customer service communications.
  • Technical data: security and system logs, IP address, device/browser information, usage data and cookies (see Cookie Policy).

Nature of data provision: data necessary for registration and/or purchase (e.g. contact details, shipping address, tax data where required) are mandatory. Failure to provide such data may prevent order fulfillment. Marketing/newsletter data and non-essential cookies are optional.

  • Performance of a contract (Art. 6(1)(b) GDPR): account management, order processing, payments, delivery, customer service and returns.
  • Legal obligation (Art. 6(1)(c) GDPR): accounting, tax compliance, invoicing and record keeping.
  • Legitimate interest (Art. 6(1)(f) GDPR): fraud prevention, website security, legal protection and service improvement.
  • Consent (Art. 6(1)(a) GDPR): newsletter/marketing communications and non-essential cookies, where activated.

Payment Processing

Payment instrument data (e.g. card details) are processed directly by the respective payment service providers (PSPs). MOMODIVE receives and stores only the payment status and transaction references necessary for order management and accounting purposes.

Shipping and Logistics (Packlink)

MOMODIVE uses Packlink to manage shipments. Delivery data (name, address, phone number) are transmitted to Packlink for organizing transportation with selected carriers. All couriers are managed through Packlink.

Security, Fraud Prevention and Website Protection

To ensure infrastructure security and prevent unauthorized access, spam and automated abuse, this website uses advanced protection systems integrated into the Security Pro module.

Google reCAPTCHA v3

This website uses Google reCAPTCHA v3 to analyze traffic and prevent automated or fraudulent use of forms (e.g. contact forms, account registration, login and other protected interactive modules).

From April 2, 2026, Google acts as a Data Processor for reCAPTCHA, processing data exclusively on behalf of the Data Controller in accordance with the Google Cloud Data Processing Addendum.

Processed data may include IP address, browser information and browsing behavior strictly necessary for risk assessment and abuse prevention.

Google Safe Browsing v4

The website also uses Google Safe Browsing v4 to detect potential security threats, malware or harmful content in order to protect users and infrastructure.

Such processing is based on the legitimate interest of the Data Controller (Art. 6(1)(f) GDPR).

Analytics, Social Media and External Content

We may use traffic analysis tools (e.g. Google Analytics 4) and third-party widgets (e.g. YouTube, social networks). The use of cookies and tracking technologies is governed by our Cookie Policy and consent banner.

Live Chat and Messaging Services

Smartsupp – Live Chat

This website uses the Smartsupp live chat service to provide real-time customer support. The service may collect data such as IP address, device/browser information, visited pages and the content of messages voluntarily sent by users through the chat.

The service is activated only after consent to non-essential cookies, where required by the cookie banner.

WhatsApp Business

This website may include a direct contact button via WhatsApp. By clicking the button, users are redirected to the WhatsApp platform (managed by Meta Platforms). In this case, data are processed directly by WhatsApp according to its own Privacy Policy.

  • technical/IT service providers, hosting and security providers;
  • payment service providers (PSPs);
  • Packlink and, through Packlink, the appointed carriers;
  • accounting and tax consultants;
  • competent authorities, where required by law.

International Data Transfers

Some providers (e.g. Google, PayPal) may process data outside the European Economic Area. In such cases, transfers are carried out based on adequate safeguards such as:

  • EU-U.S. Data Privacy Framework (DPF), where applicable;
  • Standard Contractual Clauses (SCCs) adopted by the European Commission.

Data Retention Period

  • Order and accounting data: up to 10 years (legal obligation).
  • Customer account data: as long as the account remains active.
  • Technical and security logs: limited period proportionate to security purposes.
  • Marketing/newsletter data: until consent withdrawal.

User Rights

Users may exercise their GDPR rights (access, rectification, erasure, restriction, objection, portability) by writing to [email protected].

Users may also lodge a complaint with the competent Supervisory Authority.

Changes to this Privacy Policy

The Data Controller reserves the right to modify this Privacy Policy. In case of significant changes, the “Last update” date will be amended and, where required, consent will be requested again.

This Privacy Policy is drafted in accordance with Regulation (EU) 2016/679 (GDPR).
